The Fiktionsbescheinigung is one of the most misunderstood documents in German immigration practice. People talk about it as if it were a backup permit. It is not.
What it really does is document a legal bridge that already exists if you filed on time. That distinction matters because it changes how you should argue for it, how you should use it, and what you should never assume it covers.
What the Fiktionsbescheinigung Actually Does
Section 81(4) of the German Residence Act (Aufenthaltsgesetz) states that if you apply for a permit extension before your current permit expires, your right of residence is maintained by legal fiction until the authority makes a decision. The Fiktionsbescheinigung is the written confirmation of this legal fiction.
It is not a new permit. It does not extend your visa dates. It certifies that your existing permit continues to be valid under the law while your application is pending.
When You Need One
You need a Fiktionsbescheinigung in two situations:
1. Your permit expires before your appointment. If you submitted your renewal application in time (before expiry) but the earliest available appointment is after your expiry date, you are in legal status by fiction — but you need the paper to prove it. Employers, landlords, and border control cannot verify this from a database.
2. Your appointment is scheduled but processing takes longer than your permit's validity. The officer at LEA or KVR should issue it automatically at your appointment. If they do not, request it explicitly.
How to Request It Before Your Appointment

What It Allows

- You may continue to work in Germany under the same employment conditions as your original permit
- You may remain in Germany legally
- You are protected from administrative penalties for overstay
What It Does NOT Allow
- International travel is risky. Most countries require a valid residence permit for visa-free entry. With an expired permit and a Fiktionsbescheinigung, you may be denied boarding or entry at borders. Consult your home country's requirements and your destination country's entry rules before travelling.
- It does not give you any additional rights beyond those of your original permit.
- It expires when the authority issues a decision — either your new permit is approved, or it is rejected.
How Long Does It Take to Get One?
If you request it in writing before your appointment, Berlin LEA typically responds in 5–10 business days. Munich KVR is usually faster at 3–7 business days. Some offices issue it by post; others require a short in-person visit.
If you have an appointment scheduled, the officer will issue it on the spot at the start of your appointment if your permit has already expired or is about to.
What If Your Request Is Ignored?
If you receive no response within 10 business days, send a follow-up referencing §81(4) AufenthG and your original request date. Keep every email with timestamps.
